As one of the world’s largest hubs for digital content and creative industries, China offers
great opportunities for international creators. Backed by refined legislation, China’s
copyright framework transforms creative output into enforceable, monetizable intellectual
property—a core strategic asset for global teams in software, gaming, publishing, design,
film and digital media.
China’s copyright system is based on the Copyright Law of the People’s Republic of China
and administered by the National Copyright Administration of China (NCAC). Aligned with
the Berne Convention and WIPO Copyright Treaty, it follows the principle of automatic
protection upon creation, with foreign works enjoying equal treatment to domestic ones, no
mandatory registration needed.
However, relying solely on automatic protection is insufficient in China’s competitive digital
market. Domestic platforms, distributors and partners all require documented proof of
ownership for content approval and settlement. Without it, legitimate holders may face disputes,
content removal and blocked cooperation.
Voluntary registration with the China Copyright Protection Center (CPCC) is now a business n
ecessity. It serves as strong prima facie evidence, simplifying proof in enforcement and lawsuits.
Benefits include faster platform access, enhanced cooperation credibility, efficient infringement
response and strengthened intangible asset valuation.
A European animation studio’s success—using CPCC registration to enter platforms, secure
licenses and fight piracy—proves this value. China has a multi-layered enforcement system:
administrative actions for mass piracy, platform takedowns for online misuse, civil litigation for
compensation and criminal penalties for severe cases.
Foreign holders need no local agent for ownership but benefit from local legal support for
registration and enforcement. Protection duration is author’s lifetime + 50 years (70 for some
works); abstract ideas and procedures are unprotected.
Proactive pre-market planning—including IP audits and priority registration for high-value assets
—is key. In conclusion, China’s copyright ecosystem is maturing; by leveraging automatic
protection, voluntary registration and diversified enforcement, global creators can protect works
and maximize commercial value in China’s market.
