
The European Patent Office (EPO) released its revised Guidelines for Examination, effective
April 1, 2026, establishing the world’s first comprehensive framework for patenting
AI-related inventions.
The new rules state that patent eligibility is granted only if AI algorithms and models provide
a clear technical contribution, serve a specific practical application, and include fully
reproducible embodiments. Abstract algorithms and pure mathematical logic remain
unpatentable.
The EPO has also tightened disclosure requirements; vague or incomplete specifications will
result in direct rejection. Coupled with a 5% official fee increase starting April 2026, both the
cost and scrutiny of European patent filings have risen significantly.
Innovators worldwide risk rejection or narrowed scope without strategic planning and
high-quality drafting. Proactive, well-prepared patent applications are now essential to secure
enforceable protection in the EU market.
